Article 1: General provisions

The e-commerce website of Christy Shoe, an SRL with registered office at Avenue de Jette 240, 1090 Brussels (Jette), VAT BE0123456789, Brussels, (hereinafter ‘Vasco Shoes’) offers its customers the possibility to purchase products from its webshop online.

These Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the Vasco Shoes webshop, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, except when these have been expressly accepted in advance, in writing, by Vasco Shoes.

Article 2: Price

All prices are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be mentioned separately.

The indicated price refers exclusively to the articles as literally described. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and e-commerce website are created with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer are not binding for Vasco Shoes. Vasco Shoes is only bound to an obligation of means regarding the accuracy and completeness of the information provided. Vasco Shoes is in no case liable for manifest material errors, typesetting or printing errors.

When the Customer has specific questions about for example sizes, color, availability, delivery time or method, we request the Customer to contact our customer service in advance.

The offer is valid while stocks last and can be adjusted or withdrawn by Vasco Shoes at any time. Vasco Shoes cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly mentioned in the offer.

Article 4: Online purchases

The customer selects products in the webshop, adds them to the shopping cart and follows the ordering process. After confirmation of the order and payment method, and acceptance of the general terms and conditions, the purchase is final.

The Customer has a choice between the following payment methods:

  • By credit card (Visa, MasterCard)
  • By bank card (Bancontact, Maestro)
  • By bank transfer to account number BE12 3456 7890 1234
  • Via PayPal

Vasco Shoes is entitled to refuse an order following a serious breach by the Customer concerning orders in which the Customer is involved.

Article 5: Delivery and execution of the agreement

Articles ordered via this webshop are delivered in Belgium, the Netherlands, France, and Germany.

Delivery is made by DPD or PostNL within 1-3 working days after receipt of the order. Shipping costs amount to €4.95 for orders under €50. For orders over €50, shipping is free.

Unless otherwise agreed or expressly stipulated otherwise, the goods are delivered to the Customer’s residence within 30 days after receipt of the order.

Any visible damage and/or qualitative deficiency of an article or other deficiency at delivery must be reported immediately by the Customer to Vasco Shoes.

The risk of loss or damage passes to the Customer from the moment the Customer (or a third party designated by the Customer, who is not the carrier) has physically taken possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier if the carrier was commissioned by the Customer to transport the goods and this choice was not offered by Vasco Shoes.

Article 6: Retention of title

The delivered articles remain the exclusive property of Vasco Shoes until the time of full payment by the Customer.

The Customer undertakes to inform third parties, if necessary, of Vasco Shoes’ retention of title, e.g., to anyone who might seize articles that have not yet been fully paid for.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase articles online from Vasco Shoes in their capacity as consumers.

The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day on which the Customer, or a third party designated by the Customer who is not the carrier, physically takes possession of the goods.

To exercise the right of withdrawal, the Customer must inform Vasco Shoes (Avenue de Jette 240, 1090 Brussels, info@vasco-shoes.be) of their decision to withdraw from the contract by means of an unequivocal statement (e.g., a letter sent by post or email). The Customer may use the model withdrawal form, but is not obliged to do so.

To meet the withdrawal deadline, the Customer must send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Vasco Shoes, Avenue de Jette 240, 1090 Brussels, without undue delay and in any event not later than 14 calendar days from the day on which the Customer communicated their decision to withdraw from the contract to Vasco Shoes. The deadline is met if the Customer sends back the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

If the returned product has diminished in value in any way, Vasco Shoes reserves the right to hold the Customer liable and claim compensation for any reduction in the value of the goods resulting from the Customer’s handling of the goods that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Only articles that are in the original packaging, together with all accessories, instructions for use, and invoice or proof of purchase can be taken back.

If the Customer withdraws from the contract, Vasco Shoes will reimburse all payments received from the Customer up to that point, including standard delivery costs, no later than 14 calendar days after Vasco Shoes has been informed of the Customer’s decision to withdraw from the contract. For sales contracts, Vasco Shoes may withhold the reimbursement until it has received all goods back or until the Customer has supplied evidence of having sent back the goods, whichever is the earliest.

Vasco Shoes will reimburse the Customer using the same means of payment as the Customer used for the initial transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not incur any fees as a result of such reimbursement.

The Customer cannot exercise the right of withdrawal for:

  • The delivery of goods made to the Customer’s specifications or clearly personalized
  • The delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery
  • The delivery of sealed audio or video recordings or sealed computer software which have been unsealed after delivery

Article 8: Guarantee

Pursuant to the law of September 21, 2004 concerning the protection of consumers in respect of the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner, and has a 2 year duration. Any commercial guarantee leaves these rights unaffected.

To make a claim under the guarantee, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For articles purchased online and delivered to the Customer’s home, the Customer must contact Vasco Shoes customer service and return the article to Vasco Shoes at the Customer’s expense.

Upon discovering a defect, the Customer must inform Vasco Shoes as quickly as possible. In any case, any defect must be reported by the Customer within a period of 2 months after detection. Thereafter, all rights to repair or replacement expire.

The guarantee is never applicable to defects arising as a result of accidents, negligence, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the operating instructions or manual, adjustments or modifications to the article, rough use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase or delivery, as the case may be, are deemed not to be hidden defects, unless proven otherwise by the Customer.

Article 10: Penalties for non-payment

Without prejudice to the exercise of other rights available to Vasco Shoes, in the event of non-payment or late payment, the Customer shall automatically and without formal notice be liable to pay interest at a rate of 10% per annum on the unpaid amount from the date of the breach of contract. Furthermore, the Customer shall automatically and without formal notice be liable to pay a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Notwithstanding the foregoing, Vasco Shoes reserves the right to take back articles that have not been (fully) paid for.

Article 11: Privacy

The data controller, Vasco Shoes, respects the Belgian law of December 8, 1992 on the protection of privacy in relation to the processing of personal data.

The personal data you provide will only be used for the following purposes: execution of the contract entered into, processing of the order, sending newsletters, advertising and/or marketing purposes.

You have a legal right to access and possibly correct your personal data. Upon proof of identity (copy of ID card), you can obtain free of charge the written communication of your personal data through a written, dated and signed request to Vasco Shoes, Avenue de Jette 240, 1090 Brussels, info@vasco-shoes.be. If necessary, you can also request the correction of data that would be incorrect, incomplete or not relevant.

You can oppose the use of your data for direct marketing purposes free of charge. For this purpose, you can always contact Vasco Shoes, Avenue de Jette 240, 1090 Brussels, info@vasco-shoes.be.

We treat your data as confidential information and will not pass it on, rent it or sell it to third parties.

The customer is responsible for maintaining the confidentiality of their login details and the use of their password. Your password is stored in encoded form, so Vasco Shoes has no access to your password.

Vasco Shoes keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent.

Article 12: Use of cookies

During a visit to the site, ‘cookies’ may be placed on the hard drive of your computer. Article 13: Impairment of validity - non-waiver

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

Any failure at any time by Vasco Shoes to enforce any of the rights set out in these Terms, or to exercise any right thereof, shall never be considered as a waiver of such provision and shall never affect the validity of these rights.

Article 14: Amendment of terms

These Terms are supplemented by other conditions explicitly referred to, and the general sales conditions of Vasco Shoes. In case of contradiction, these Terms shall prevail.

Article 15: Evidence

The Customer accepts that electronic communications and backups can serve as evidence.

Article 16: Applicable law - Disputes

Belgian law is applicable, with the exception of the provisions of international private law regarding applicable law.

The courts of the Consumer’s place of residence are competent for judicial disputes. The Consumer can also address the ODR platform (http://ec.europa.eu/consumers/odr/).
